ROCKINGHAM COUNTY, Va. — A former Luray Police Department (LPD) captain was recently sentenced in Harrisonburg/Rockingham General District Court.
At 6:37 a.m. on May 26, 2024, Michael Wagoner, then 56, was arrested for driving under the influence. Rockingham County Sheriff’s Deputy N.S. Brady charged Wagoner with §18.2-266 / DWI, 1st offense. He was released on bond.

Wagoner, who had been with the LPD for nearly a decade, submitted his resignation days after the arrest, and was scheduled to appear in court again on June 10, 2024.
The case was continued to June 17, but on that date, Wagoner was unexpectedly absent. He was issued a show-cause summons on a misdemeanor charge of failure to appear (§18.2-456) — which is considered contempt of court.
Several case continuance dates were scheduled between July 8, 2024, and April 3, 2025. Wagoner did not fail to appear on any of those dates.
On July 9, 2025, the case was finalized.
According to online court documents, Wagoner was found guilty and sentenced to 90 days of jail time (90 days suspended). He was also sentenced to 12 months of supervised probation, although court records do not specify a start date. His driver’s license was suspended for 12 months.
In addition to a $250 fine, Wagoner is also responsible for $211 in court costs.
The failure to appear charge was dismissed.
